Aviation Tariff
Effective October 1, 1996
Updated April 1, 2001


By virtue of authority granted under Title 29, Section 543 (12) of the Virgin Islands Code, the Virgin Islands Port Authority hereby establishes the following rates, fees and charges for use of its airport facilities and services as provided, effective October 1, 1996 until repealed or amended.

A. Aircraft Landing Fees
Applicable to each aircraft except touch-and-go, search and rescue missions, or emergency return flights. Computed on the aircraft’s maximum allowable landing weight per 1,000 pounds or any fraction thereof, as follows:

1. Carriers per 1,000 lb.

2. Minimum charge for landing (aircraft weighing less than 5,000 lb.)

B. Aircraft Parking Fees
Subject to space availability and the rules and regulations of the Airport and applicable to all aircraft in addition to the landing fee for the following categories:

Terminal Ramp

1. Parking in excess of 30 minutes for aircraft weighing up to 12,500 lb. maximum gross weight (MGW) and in excess of one (1) hour for aircraft weighing over 12,500 lb. MGW per hour or fraction thereof.
1/3 landing fee amount per day

2. Overnight monthly parking, 121 carriers, on ramp per month

a. 34 seats or less $500.00
b. 35 - 65 seats $750.00
c. 66 seats and up $4,500.00

General Aviation Ramp

3. Daily parking in excess of eight hours and for each successive calendar days or fraction over eight (8) hours thereof.
15% of landing fee amount (minimum rate $10.00 per day)

4. Overnight monthly parking - Residents of the U.S. Virgin Islands with locally based aircraft may elect to pay a monthly parking fee in advance, in lieu of the daily rate:

a. Aircraft weighing up to 12,500 lb., monthly amount per engine per space: $50.00
b. Aircraft weighing over 12,500 lb., monthly amount per engine per space: $75.00

C. Terminal Rents and Use Charges

1. Per Passenger Rates Common to Both Airports

a. Preclearance Departure Facilities - For each departing passenger using the preclearance facilities.

b. Other Departure Holdroom Facilities - For each departing passenger other than precleared passengers.

c. Foreign Arrival Facilities - For each arriving passenger (including passengers in transit) who utilize the inbound customs/ immigration facilities.

4. Terminal Goods/Other Services
Reimbursement shall be on an at-cost plus expenses basis for electricity, water, Public Address system, music, trash removal, custodial, and any goods or services provided by the Virgin Islands Port Authority other than those covered by the user fee above; specific fees include:

a. Law Enforcement Officer with Territorial power of arrest as set by the FAA; per passenger screened: $ .25

b. Interest fee of one and one-half percent (1½ %) per month of any amount over 30 days: Same

D. Other Charges

1. Cargo Warehouse space, per square foot per year -Market Value
2. Improved or unimproved land, per square foot per year - Market Value
3. Fuel Flow Fee - fuel sold on airports, per gallon $ .02
4. Special Services

a. Foaming runway, replacing foaming agent
At cost

b. Assisting removal of disabled aircraft, reimbursement of outside cost
As Applicable

c. Other services (Security, electricity, trash removal, etc.)
At cost

E. Bournefield Housing

a. One Bedroom, per month $275.00

b. Two Bedrooms, per month $300.00

c. Three Bedrooms, per month $325.00

DEFINITIONS

1. Landing Fee: A charge for the use of the runways, taxiways and ramp areas computed on the aircraft’s maximum allowable landing weight ( M.A. L. W.) per thousand pounds, or any fraction thereof. A touch-and-go, search and rescue mission or and emergency return flight is not charged a landing fee. Search and rescue flights must be non-commercial and in response to a declared emergency, that has been approved by the Airport Manager’s office prior to departure.

3. Terminal Ramp Parking Fee: A charge for occupying the passenger ramp parking area. Commences after 30 minutes on aircraft weighing u to 12,500 lbs. M.G.W. and after one hour, on aircraft weighing more than 12,500 lbs. M.G.W. The charge made will be for each hour of time, or part thereof, after the permitted time expires. Scheduled aircraft with minor mechanical delays may have this charge excused by the Airport Manager. Major mechanical delays may necessitate relocation of aircraft should the Airport Manager so require. Locally based charter aircraft may be assigned a ready position by the Airport Manger on the ramp (space permitting), in which the ramp parking fee will not apply.

4. Daily Parking Fee: A charge for occupying parking space designated as a continuous public parking area, away from the passenger terminal ramps. Not applicable to tenant’s aircrafts parked solely on property leased to tenant for aeronautical use. Locally based aircraft on which a monthly parking fee is paid are exempt form the daily parking fee. Charges commence after eight hours and is per 24 hour period, or part thereof after eight hours.

5. Monthly Parking Fee: A charge for occupying parking space designated as a continuous public parking area, away from passenger terminal ramps.

6. Counter Space/ Air Conditioned: A charge for space in an enclosed air conditioned building. Air conditioning is provided by the Authority. All utilities are the responsibility of the tenant. A minimum charge is established.

7. Counter Space/ Non Air Conditioned: Air conditioning is not provided. All other conditions are the same as described above. A minimum charge is established.

8. Office Space/ Non Air Conditioned: A charge for space in an enclosed area. Air conditioning is not provided by the Authority. All utilities are for the account of the tenant.

9. Office Space/ Non Air Conditioned: A charge for space in an enclosed area. Air conditioning is not provided by the Authority. All utilities are for the account of the tenant.

10. Baggage Space/ Air Conditioned: A charge computed on the square foot area leased for baggage room or makeup area, or whether the area is air conditioned or not. No minimum charge is established.

11. Cargo Warehouse Space: A space computed on the square foot area of space leased for storing, receiving or delivering air cargo. A minimum charge is established.

12. Unimproved Land Area: A charge computed on the square foot area of bare open space lease for use in conducting permitted business. Fair Market Value as determined by an appraisal shall mandate fee to be charged.

13. Baggage Delivery Facility: A charge assessed the aircraft operator on the total number of occupants on an aircraft including non-revenue passengers (flight crew not counted) for the use of the baggage claim facility for delivering baggage to passengers, or to aircraft via baggage cart.
